TERMS AND CONDITIONS OF SALE

THESE TERMS AND CONDITIONS OF SALE (“TERMS”) CONTAIN VERY IMPORTANT INFORMATION REGARDING YOUR RIGHTS AND OBLIGATIONS, AS WELL AS CONDITIONS, LIMITATIONS, AND EXCLUSIONS THAT MIGHT APPLY TO YOU. THESE TERMS APPLY ONLY TO THE SERVICES IDENTIFIED BELOW (THE “SERVICE” OR “PROGRAM”). INHALE FOR OM MAY MAKE AVAILABLE OTHER SERVICES (“THIRD-PARTY SERVICES”) ADMINISTERED BY A THIRD-PARTY (“THIRD-PARTY SERVICE PROVIDER”). YOUR USE AND ACCESS OF THIRD-PARTY SERVICES ARE GOVERNED BY THE THIRD-PARTY SERVICE PROVIDER’S PRIVACY POLICY AND TERMS OF SERVICE.

These Terms incorporate by reference the INHALE FOR OM RISK ACKNOWLEDGEMENT RELEASE AND LIABILITY WAIVER FORM. These Terms together with the INHALE FOR OM RISK ACKNOWLEDGEMENT RELEASE AND LIABILITY WAIVER FORM constitute the entire agreement for your use of Services or Programs being purchased, which is made available by Inhale for Om LLC (herein referred to as Inhale for Om, us, we, or our as the context may require). These Terms are subject to change by us without prior written notice at any time, in our sole discretion. Any changes to these Terms will be in effect as of the “Last Updated Date” and accessible via THE INHALE FOR OM TERMS AND CONDITIONS OF SALE. The INHALE FOR OM RISK ACKNOWLEDGEMENT RELEASE AND LIABILITY WAIVER FORM is also subject to change, and you are responsible for reviewing those terms periodically. Your continued use of the Service will constitute your acceptance of and agreement to all such changes.

1. ORDER ACCEPTANCE/CONFIRMATION. You agree that your order is an offer to buy under these Terms. Inhale For Om reserves the right to accept or reject orders in its sole discretion.
2. SERVICES. Inhale For Om’s offers onsite yoga retreats (Yoga Retreats), onsite (in-person) yoga classes/guided mediations other than those offered in connection with a yoga retreat (Onsite Services), online yoga classes/guided meditations (Online Programs), collectively referred to herein as Services or Programs. Please note that in connection with the Services or Programs provided herein, schedules provided are estimates. All times, classes, workshops, experiences, activities, excursions, and locations are subject to change. All workshops, activities, excursions, yoga classes, meditation classes are optional, and you are encouraged and empowered to participate or not as you desire.
3. PRICING/PAYMENT.
   1. US Dollars. All prices are in US dollars.
   2. Prices Subject to Change. All posted or advertised prices posted are subject to change without notice. The price charged for the Service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Price increases will only apply to orders placed after such changes. Posted prices do not include taxes or charges for shipping and handling. All such taxes and charges will be added to your order total (as applicable) and will be itemized in your order confirmation email. We are not responsible for pricing, typographical, or other errors in any offer made by us and we reserve the right to cancel any orders arising from such errors.
   3. Payment Terms; Method. Terms of payment are within Inhale For Om’s sole discretion and are currently processed via STRIPE. Payment processing is governed by the STRIPE’S terms and conditions and privacy policies, available at Payment Terms (stripe.com). Full payment is due at time of registration and can be made with Visa, MasterCard, American Express, or Discover. You represent and warrant that (i) the credit card information you supply to us is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including all applicable taxes, if any.
   4. Cancellations and Refunds. All registrations and bookings are subject to Inhale For Om’s cancellation policies listed below. PLEASE REVIEW THE SPECIFIC CANCELLATION AND REFUND POLICIES FOR EACH SERVICE DESCRIBED BELOW:
      1. Yoga Retreats and Yoga Teacher Trainings. 

         All payments made to Inhale For Om are final. Your deposit secures your spot and is non-refundable and non-transferrable to another person or another program. Full payment for any Yoga Retreat or Yoga Teacher Training program is due no later than 90 days prior to the start date of the respective program. All payments are non-refundable and non-transferable, meaning that once a payment is made, it cannot be refunded, credited, or applied to a different retreat, training, program, or person.

         Payment Plans

         If a payment plan option is selected, all scheduled payments must be made on timeaccording to the agreed-upon schedule. Each payment made is non-refundable and non-transferable and cannot be used toward another retreat, training, or participant. Failure to make timely payments may result in forfeiture of your spot without refund or credit.

      2. Onsite (In-Person) Yoga Classes and Wellness Programming (Onsite Services). Your payment for Onsite Services is non-refundable and secures your spot. All payments must be made on time and in advance of the program to have access to the on-site programming.
      3. Online Yoga Classes and Guided Meditations (Online Programs). No refunds or credits are available for any Online Programs.
      4. Other Cancellations. No other refunds or credits are available. Inhale for Om’s standard cancellation policy applies to all other charges. Please note that cancellation of program involvement also includes any dismissal by Inhale for Om administration due to violations of these terms or any other related agreements or policies. INHALE FOR OM RESERVES THE RIGHT TO CANCEL ANY SERVICE OR PROGRAM AT ANY TIME. IN THIS EVENT, YOU WILL BE GIVEN A COMPLETE REFUND OR CREDIT (AT OUR DISCRETION). ANY REFUND GRANTED WILL BE CREDITED BACK TO THE ORIGINAL PAYMENT METHOD OR CARD; AND ANY CREDITS GRANTED AT THE DISCRETION OF INHALE FOR OM WILL BE APPLIED TO YOUR INHALE FOR OM ACCOUNT AND WILL REMAIN VALID FOR A PERIOD OF 12 MONTHS FROM THE DATE OF CANCELLATION.

4. PARTICIPANT RESPONSIBILITIES. For Yoga Retreats and Onsite Services, you are responsible for transportation to and from Yoga Retreat location or other Onsite location, and any additional costs related to your attendance (e.g., excluded meals, excluded activities, etc.) unless expressly included in the specific Yoga Retreat or other Service package.  You are encouraged to obtain travel insurance for your Yoga Retreat.

5. TRAVEL INSURANCE REQUIREMENT. For all Yoga Retreats and Yoga Teacher Trainings, guests are required to purchase travel insurance. This insurance is essential to cover any unforeseen circumstances, including but not limited to illness, emergencies, trip interruptions, and cancellations. Inhale For Om is not responsible for any costs incurred due to changes in travel plans, and we highly recommend selecting a comprehensive policy that includes coverage for retreat cancellations. Travel insurance must be purchased within 30 days of booking.

6. RELEASE OF LIABILITY. You hereby release Inhale for Om from any and all liability arising out of or related to Services or Programs provided by Inhale for Om.

7. WAIVER. You hereby waive and release Inhale for Om from any and all liability arising out of or related to your participation in the Services or Programs. You hereby acknowledge and agree that you are participating in the Services, Programs, and any Third-Party services at your own risk.

8. ASSUMPTION OF RISK. You hereby acknowledge and agree that you are aware of the risks associated with the Services, Programs, and Third-Party Services and agree to assume the risks associated with such participation.

9. INDEMNIFICATION. You hereby agree to indemnify and hold harmless Inhale for OM from and against any and all claims, damages, losses, liabilities, costs, and expenses arising out of or related to your participation in the Services and Programs.

10. WEBSITE PRIVACY STATEMENT. We understand the importance of protecting your privacy while online. This privacy statement explains the data collection and use practices of our website. We collect personally identifiable information from you when you register for our Services or Programs. This information may include your name, email address, and payment information. We may also collect non-personally identifiable information, such as your IP address, browser type, and operating system. We use the personally identifiable information you provide to process your orders, respond to your inquiries, and provide customer service. We may also use your information to personalize your experience.

11. PHOTO RELEASE.  You give permission for Inhale for Om LLC to use images (including still and video) of you taken during Yoga Retreats, Onsite Services, or Online Programs without recourse to you and without compensation to you, for publicity and promotion purposes only through whatever medium it chooses.

12. SEVERABILITY. If any of the term set forth herein is held to be invalid, illegal, or unenforceable, the validity, legality, and enforceability of the remaining terms and provisions shall remain in full force and effect.

13. GOVERNING LAW. These terms and conditions shall be governed by the laws of the State of North Carolina.
